Welcome to Payton Violins LLC. By using our services, you agree to comply with and be bound by the following terms and conditions. We have designed these terms to ensure that we can continue offering the highest level of service and care to our valued clients. Please review the following terms carefully. If you do not agree to these terms, you should not use our services.

1. Definitions

• Company: Payton Violins LLC, a limited liability company in the state of New York.
• Customer: Any individual or entity purchasing, renting, repairing, or appraising instruments through Payton Violins LLC.
• Instrument: Violins, violas, cellos, bows, services and accessories sold, rented, or repaired by the Company.

2. Retail Sales

• All sales are final. Returns and exchanges are subject to the Company’s return policy.
• Payments are due in full at the time of purchase unless otherwise agreed in writing.

3. Rentals

• Rental agreements are subject to the terms outlined in the rental contract provided at the time of rental.
• Rental payments are due as specified in the rental agreement.
• The Customer is responsible for the care and maintenance of rented instruments. Any damage beyond normal wear and tear may be billed to the Customer.

4. Repairs

• Repair estimates are provided upon request. Actual repair costs may vary based on the extent of the repairs.
• Payments for repairs are due upon invoicing.
• Instruments left for repair with unpaid invoices past 30 days may incur a 15% late service fee.
• Instruments left with unpaid repair invoices past 60 days will be forfeited to the Company in lieu of the repair cost.

5. Certificates and Insurance Appraisals

• The Company provides certificates of authenticity and insurance appraisals upon request.
• Fees for these services are due upon completion of the service.

6. Payment Terms

• All invoice payments are due when invoiced.
• Invoices left unpaid for more than 15 days can be billed to any card on file.
• Invoices left unpaid for more than 30 days will be subject to a late service fee equal to 15% of the invoice amount.
• Invoices older than 60 days may be sent to collections, with an additional 20% late service fee.

7. Liability

• - The Company is not responsible for any damage or loss resulting from the use of our products or services.
• - The Customer agrees to indemnify and hold harmless the Company from any claims, damages, or expenses arising from the use of our products or services.

8. Governing Law

• These terms and conditions are governed by the laws of the state of New York. Any disputes arising from these terms will be resolved in the courts of New York.

9. Amendments

• The Company reserves the right to amend these terms and conditions at any time. Changes will be posted on our website and will be effective immediately upon posting.
